It most commonly happens when a judgment is filed that divides an account or when the case is dismissed. Below is a general list of ways to remove a claim on a CalPERS account.

Request for Dismissal: If a member’s CalPERS account has a claim resulting from a filed and served Joinder but a judgment has not been filed, CalPERS requires a “Request for Dismissal”. Judicial Counsel form CIV-110 is commonly used to remove the claim. The request must be signed and filed at the court before submitting it to CalPERS. Notarized Letter: If a claim was placed on a CalPERS account by way of a written claim letter, CalPERS requires a notarized letter from the party who initially submitted the claim letter to remove the hold. The notarization confirms to CalPERS the letter is in fact being submitted by the party who requested the claim on the account.

Court Order: A filed court order, signed by the judge, can be provided to CalPERS to remove a claim placed on an account by a joinder. The court order can either confirm that no community interest exists to the non-member or that the community property issue has been resolved. Typically this is a divorce judgment.
