Petition to Determine Succession to Real & Personal Property – When real property is valued at more than $50,000.00 but less than $150,000.00 we help prepare the documents for the streamlined process of transferring assets through the probate court. When this process can be used, the fees are significantly lower due to the fact that there are fewer steps to complete and much less paperwork to file. The time it takes to get a final order to transfer the property is also much quicker. The Process – Petition to Determine Succession to Real Property
A court appointed appraiser, called a probate referee will first value the property being transferred as to the date of death. As long as the value is at or below the $150,000.00 limit the referee’s certification is filed at the court with the Petition. Unlike a regular probate, the petition to determine succession to real and personal property must be signed by all the legal heirs or beneficiaries. Once the documents are filed and the fees paid to the court, a hearing will be set up which usually takes about 30 days. As long as everything is done correctly and in a timely manner, the judge will sign the order at the hearing. The final step is having the probate clerk certify the order, which can be done the same day and then recorded at the county recorder.
