What is Child Custody?
Child custody refers to a court order that awards a parent rights and responsibilities for the care, control and maintenance of minor children. Custody is addressed in divorce, legal separation and proceedings to establish a parental relationship. Once orders have been established they are always subject to modification based on what is in the best interest of the minor children involved.
Custody – The Process
Acquiring a new custody order is integrated in the petition for a dissolution of marriage, a legal separation or a parental relationship establishment. Custody orders can be granted without a court hearing if both parents are in agreement and the best interests of the children are met. If one parent fails to participate in the case, custody orders can still be granted. If the parents cannot reach an agreement, an order will be made by the judge after a court ordered mediation appointment. Most parents who go to mediation work out an agreement, which is then ordered at the hearing. When parents are unable to work out an agreement in mediation, the process to obtain custody orders can become very complicated and an attorney should be consulted. Some family law courts use a triage system to help parents get orders in one day rather than making two trips to the court. In emergency circumstances, temporary custody orders can be made in one or two days.
The process to modify an existing custody order is the same except that there is less paperwork due to the fact that a judgment has already been entered. The fees to obtain a modified order will be significantly lower because of that.
