Child Support – The Process
The process for getting a court order for child support is different depending on whether you are trying to establish a new order, or if you are trying to modify an existing order.
Establishing Child Support at the Family Law Court: Requests for child support at the family law court are usually in conjunction with petitions for child custody or divorce. An order for child support is granted either after a mutual agreement is reached between the parents, after a court hearing or by default of the party who did not respond to the request. The parents can agree to any monthly amount they agree will meet the needs of the child as long as there is no government assistance being provided. It has been said that when the parents mutually agree on what the order should be, it is usually paid and collection doesn’t become a problem. When parents cannot agree, the court will award child support based on the state’s child support guidelines. When the other party doesn’t participate in the family law case, orders for child support can be awarded without a hearing (by default). Orders made by agreement are usually granted faster. Orders made at a hearing will usually happen about 30-40 days from the request. Orders made by default can take a few weeks longer, but not always.
Modifying an Existing Child Support Order: When circumstances have changed and the current child support order doesn’t meet the needs of the child anymore, two common processes are available. The fastest easiest way is always when both parents mutually agree to what the new order should be. As long as the parties sign a proper agreement knowingly and intelligently (they know what the order would have been if the court ordered it by guideline) and no claim for government assistance is pending, an order is usually signed by the judge within a few weeks without a court appearance. When an agreement can’t be reached, the court will determine the child support at a hearing that will not happen sooner than 30 days.
The Department of Child Support Services is a separate agency that also establishes and modifies child support orders most commonly when government assistance is requested. Many times their child support cases are handled concurrently with cases for the same children in family law court for custody and visitation issues, which they do not handle. Because the DCSS is a large agency, it usually takes longer to process child support orders. However, as a government agency, they have a better means to enforce existing child support orders as they are connected to agencies such as the Department of Motor Vehicles, all state licensing agencies and the Franchise Tax Board. Even if the parent obligated to pay leaves the state of California, the DCSS can sometimes find them and enforce the orders with sister-state judgments.
