When the decedent’s assets are valued at more than $150,000.00 and are not being transferred to the beneficiaries or heirs by any other simpler methods, a standard formal probate may be required. There are several steps to take to complete a standard probate. In addition to filing several documents, a legal notice will be published in the newspaper, notices will be mailed, and a probate referee is hired. Usually a Taxpayer Identification Number will be obtained, a bank account for the estate opened and taxes filed. There is a minimum of 2 court hearings. The soonest the probate case could go through the entire court process is seven months.
