This signed and notarized document, also referred to as a small estate affidavit, gives the person or persons with the legal right to inherit the property the ability to collect it without going to probate court. The value of the estate must be less than $150,000.00. Some of the property that belonged to the decedent might not be included in determining the estate value. Please read the probate code to determine what property should be excluded. This document cannot be used sooner than 40 days from the date of death.
