Freezing an account is officially referred to by CalPERS as placing a “Claim”. There are several methods to placing a claim on a CalPERS account and, if part of, or starting a family law case a “Joinder” is a common method used.

How Long Does the QDRO Process with CalPERS Take?

From start to finish the QDRO process with CalPERS can vary. Typically, the fastest a QDRO with CalPERS can be done is 31 days, this is because after a joinder in filed and served on CalPERS the court requires a 30 days wait period to move forward. Assuming the QDRO is approved by CalPERS and signed by the parties, it can be turned into the court on the 31st day. From there most courts take about 2-4 weeks to process and return the documents. 60 days would be a safe estimate for the quickest processing but depending on processing times of CalPERS and local courts it can go up from there.
